Eluvia Path (“Eluvia Path”, “we”, “us”, or “our”) is an ecological bag company based in Montréal, Québec, Canada, specialising in sustainably produced jute and cotton bags.

By accessing or using our Services, you confirm that you are at least 18 years of age (or the age of majority in your province or territory), that you have read and understood these Terms, and that you agree to be bound by them. If you do not agree, please do not use our Services.

Eluvia Path is a Montréal-based ecological bag company with over 4 years of experience producing high-quality jute and cotton bags. Our bags are carbon neutral, made in ETI certified and SEDEX registered factories using 100% naturally sourced fibres. We are committed to ethical trading, sustainable practices, and transparent business conduct.

2. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Eluvia Path. By:

3.1 Permitted Use

You may use our website for lawful purposes only, in accordance with these Terms and all applicable Canadian federal and provincial laws. You agree to use our Services only to:

3.2 Prohibited Conduct

We reserve the right to suspend or terminate access to our Services for any user who violates these Terms, without notice and at our sole discretion.

4. Products and Product Descriptions

4.1 Accuracy

We make every effort to ensure that product descriptions, images, dimensions, and material information on our website are accurate and up to date. However, we do not warrant that descriptions or other content are entirely free of errors. Product images are for illustrative purposes and colours may vary slightly depending on your screen settings.

4.2 Natural Variation

Because our bags are made from 100% natural fibres — primarily jute and cotton — there may be minor natural variations in texture, weave, and tone between individual bags. These variations are inherent to natural materials and are not considered defects.

4.3 Product Availability

All products are subject to availability. We reserve the right to discontinue any product at any time without notice. If an item in your order is unavailable after your purchase, we will contact you with options including a substitute, store credit, or a full refund.

5. Pricing and Payment

5.1 Prices

All prices displayed on our website are in Canadian Dollars (CAD) and are exclusive of applicable taxes unless otherwise stated. Taxes (GST/HST/QST where applicable) will be calculated and added at checkout based on your delivery address.

5.2 Price Changes

We reserve the right to change prices at any time without prior notice. The price applicable to your order is the price displayed at the time you complete checkout. Price changes will not affect orders already confirmed.

5.3 Payment

We accept payment by major credit cards and other methods as offered at checkout. All payment transactions are processed through secure, third-party payment processors. Eluvia Path does not store full payment card details. By submitting a payment, you represent that you are authorised to use the chosen payment method.

5.4 Failed Payments

If a payment is declined or reversed, we reserve the right to cancel your order. We may attempt to contact you to resolve the issue. Eluvia Path is not liable for any losses arising from a failed or delayed payment.

6. Orders and Contract Formation

6.1 Placing an Order

By placing an order on our website, you are making an offer to purchase the selected products subject to these Terms. An order confirmation email does not constitute acceptance of your offer — it is an acknowledgement that we have received your order.

6.2 Order Acceptance

A binding contract is formed between you and Eluvia Path only when we dispatch your order and send you a shipping confirmation. We reserve the right to refuse or cancel any order at any time for any reason, including but not limited to:

Pricing errors on the website
Product unavailability
Suspected fraud or violation of these Terms
Inability to process payment

In such cases, you will receive a full refund of any amount paid.

6.3 Order Cancellations by You

You may cancel a standard order before it is dispatched by contacting us immediately. Once dispatched, cancellations are not possible and returns must be handled in accordance with our Return & Refund Policy.

7. Custom and Printed Orders

Eluvia Path offers custom logo printing and branded bag production. The following additional terms apply to custom orders:

Artwork Approval: You are responsible for reviewing and approving all artwork proofs before production begins. Once you approve a proof, production cannot be reversed.
Accuracy: You confirm that any artwork, logo, or text you submit does not infringe upon any third-party intellectual property rights, and that you have all necessary rights and permissions to use it.
Lead Time: Custom orders require approximately 10 working days for production, in addition to standard processing and shipping time. Total lead time is typically 10–15 business days before dispatch.
Non-Refundable: Custom-printed bags are non-refundable unless they contain a manufacturing defect or do not match the approved proof. See our Return & Refund Policy for full details.
Minimum Orders: Minimum quantities may apply depending on bag style and printing method. These will be communicated to you before order confirmation.

Important: Eluvia Path is not responsible for custom orders containing artwork errors that were present in the approved proof. Please review proofs carefully before approving.

8. Shipping and Delivery

We ship to all provinces and territories across Canada. Delivery timelines, rates, and eco-friendly packaging details are set out in our Shipping Policy, which forms part of these Terms. Key points:

Free shipping on all orders over $75 (CAD) within Canada
Standard orders dispatched within 2–5 business days from Montréal
Tracking information provided upon dispatch
All orders shipped in plastic-free, eco-friendly packaging
Eluvia Path is not responsible for delays caused by carriers, weather, or incorrect addresses

9. Returns and Refunds

Our return and refund terms are set out in full in our Return & Refund Policy. Key points:

Returns accepted within 30 days of delivery on standard, unused, non-custom items
Custom-printed bags are non-refundable unless defective
Refunds issued to the original payment method within 5–10 business days of receiving the return
Return shipping costs are the responsibility of the customer unless the return is due to our error

10. Intellectual Property

10.1 Our Content

All content on the Eluvia Path website — including but not limited to text, product descriptions, images, graphics, logos, icons, and the overall design and layout — is the property of Eluvia Path or its licensors and is protected by applicable Canadian and international intellectual property laws.

You may not reproduce, distribute, modify, display, transmit, or create derivative works from any part of our website content without our prior written consent.

10.2 Your Content

By submitting artwork, logos, or any other materials to us for custom printing, you represent and warrant that:

You own or have the necessary rights and permissions to use the submitted materials
The materials do not infringe upon any third-party intellectual property, privacy, or other rights

Eluvia Path is not responsible for any intellectual property infringement arising from artwork submitted by customers. You agree to indemnify and hold harmless Eluvia Path from any claims arising from your submitted content.

11. User Accounts

You may create an account on our website to manage your orders, view order history, and save your details. You are responsible for:

Maintaining the confidentiality of your account credentials
All activity that occurs under your account
Notifying us immediately if you suspect unauthorised use of your account

We reserve the right to suspend or delete accounts that violate these Terms, are inactive for an extended period, or are associated with fraudulent activity.

12. Disclaimer of Warranties

Our website and Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Eluvia Path makes no warranties, representations, or guarantees — express, implied, or statutory — including but not limited to:

Warranties of merchantability, fitness for a particular purpose, or non-infringement
That the website will be uninterrupted, error-free, or free of viruses or harmful components
That the results obtained from using our Services will meet your expectations

Nothing in these Terms limits or excludes any warranties or statutory rights that cannot be excluded under applicable Canadian consumer protection law.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Eluvia Path and its directors, employees, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our Services or products.

In any event, our total liability to you for any claim arising out of or relating to these Terms or your order shall not exceed the total amount you paid to Eluvia Path for the specific order giving rise to the claim.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under applicable law.

Eluvia Path does not endorse, control, or take responsibility for the content, privacy practices, or availability of third-party websites. These Terms are governed by and construed in accordance with the laws of the Province of Québec and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the courts located in Montréal, Québec, Canada. If you are a consumer, you may also be entitled to bring claims in the courts of your province or territory of residence, as permitted by applicable law.

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

These Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, constitute the entire agreement between you and Eluvia Path with respect to your use of our Services, and supersede all prior agreements, understandings, and representations.

We may update or revise these Terms at any time. When we make material changes, we will update the “Last updated” date at the top of this page. Continued use of our Services after changes are posted constitutes your acceptance of the revised Terms.
